Pensión sin interdicción si es posible
A través del proceso de interdicción una persona es declarada judicialmente incapaz por carecer de las aptitudes generales para gobernarse, cuidarse, decidir y administrar sus bienes, por lo cual debe ser sometida a la guarda de un tutor.
No reconocer la capacidad jurídica es una forma de limitar el ejercicio de la ciudadanía plena, por lo cual, para que las personas con discapacidad intelectual o psicosocial puedan gozar de su capacidad jurídica, como cualquier otro ciudadano y puedan decidir sobre los diferentes aspectos de sus vidas se han reconocido legalmente algunos mecanismos de apoyo que sustituyen a la interdicción.
Pese a lo anterior algunos fondos de pensiones, venían exigiendo como requisito para acceder a las pensiones, el documento probatorio de la declaratoria de interdicción, vulnerando así sus derechos fundamentales.
El dictamen de la Sentencia T-185, del 08 de mayo de 2018, dio la razón a varias tutelas interpuestas en contra de la EPS Colpensiones, dejando en evidencia que “resulta discriminatorio asumir que todas las personas con alguna discapacidad de orden cognitivo o mental deban ser declaradas interdictas y someterse a la curaduría de un tercero” para acceder a una pensión.
Todas las personas, sin distinción alguna, poseen los mismos derechos y libertades en razón a la dignidad inherente a todo ser humano. En ese sentido, la convención sobre los derechos de las personas con discapacidad reconoce el derecho de esta población a tomar sus propias decisiones y controlar sus asuntos económicos, en un marco de autonomía y respeto por su independencia individual.
